Conceptually, entrepreneurship is seen as the engine that drives a robust economy, promotes a favorable quality of life, and assures the availability of the attributes needed for meaningful living. However, like many popular concepts in this world, its limitations are normally not well acknowledged. A grouping of entrepreneurial ventures which has recently come into existence deals with the personal fiscal issues associated with the end-of-life phase of the human cycle. While generally praised as humanitarian services for society, that are assuredly (...) within legal bounds, these activities have potentially significant negative implications. When examined from an ethical perspective, some questionable practices became apparent. Three such undertakings in particular have to do with the terminally ill and are examined in this paper. The first, viatical transactions, is defined as the transfer of a life insurance policy's ownership to someone who does not have an insurable interest in the life of the insured individual. The second, creative tax shelters for wealthy people involved in estate planning, involves hiring unrelated parties, particularly those who are young and in failing health, to do the dying for the principal. The third, mind games, involves curtailing the use of medical resources for the dying. The justification for this is rationing scarce medical resources. (shrink)

While the demise of Enron has raised a number of interesting issues, such as proper governance of large corporations, and the effectiveness and efficiency of statutory direction and regulatory mechanisms, the lack of meaningful vocal stakeholder stewardship has not been one of them. While the relative “silence” of Enron’s stakeholders (watchdogs) could simply have been a communication glitch, or a temporary lapse in social morality, an understanding of hat was not said and why, could well be a significant requisite in (...) formulating meaningful measures to preclude future Enrons. Why weren’t the watchdogs barking? Why had the stakeholder alert system shut down? Further, what are the implications for then and now of this quiescence? Since Enron’s demise many questions have been asked and answered about what went wrong. But little has been said about why the stakeholders failed to speak out by exercising their fiduciary responsibilities. This paper takes a closer look at the behavior of some key Enron stakeholders. Bracken synthesizes Polanyi’s notion of morphogentic field and Whitehead’s notion of societies of actual occasions. These comments emphasize the implications of the metaphors involved in these notions. The rnetaphor of plants growing in afield lies beyond the concept of a morphogenetic field, and the metaphor of a society of interacting persons lies behind the concept of a society of actual occasions. I suggest that one of the implications of this metaphor is that there is not, as Bracken argues, a problem (...) of continuity in Whitehead’s metaphysics of events. (shrink)

Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. Ethical ideology is predicted to play a role in the occurrence of workplace deviance. Forsyths (1980) Ethics Position Questionnaire measures two dimensions of ethical ideology: idealism and relativism. It is hypothesized that idealism will be negatively correlated with employee deviance while relativism will be positively related. Further, it is predicted that idealism and relativism will interact in such a way that there will only be a relationship between idealism and deviance when relativism is higher. Results supported the hypothesized correlations and (...) idealism and relativism interacted to predict organizational deviance. Idealism was a significant predictor of interpersonal deviance, but no interaction was found. (shrink)

As a result of numerous, highly publicized, ethical breaches, firms and their agents are under ongoing scrutiny. In an attempt to improve both their image and their ethical performance, some firms have adopted ethical codes of conduct. Past research investigating the effects of ethical codes of conduct on behavior and ethical attitudes has yielded mixed results. In this study, we again take up the question of the effect of ethical codes on ethical attitudes and find strong evidence to suggest that (...) business professionals employed at firms with ethical codes of conduct are significantly less accepting of ethically questionable behavior toward most stakeholders. The authors propose the integrity capacity construct with its four dimensions (process, judgment, development and system dimensions) as a framework for analyzing and resolving behavioral, moral and legal complexity in business ethics' issues at the individual and collective levels. They claim that moral progress in business comes about through the increase in stakeholders who regularly handle moral complexity by demonstrating process, judgment, developmental and system integrity capacity domestically and globally.

It is sometimes argued that medical professionals should protect a future child's rights by prohibiting disabled parents from using technology to deliberately have a disabled child because disability is taken as an inevitable, severe threat to a child's otherwise “open” future. I will first argue that the open future that allegedly protects a child's future autonomy is precluded by the very conditions needed to develop that future autonomy. Any child's future will be narrowed as they are socialized in a way (...) that gives them the capacity for autonomous choice. However, oppressive master narratives can diminish a future child's autonomy by distorting their narrative identity and constricting their agency. In fact, the open future argument does just this by advancing one of the most damaging master narratives about disability: that disability inevitably and severely restricts a person's autonomy and closes their future. In taking properties to have powerful or dispositional essences, dispositionalism is primed to provide an account of causation. This paper lays out a challenge confronting the dispositionalist’s ability to account for how powers causally interact with one another so as to bring about collective results. The challenge, here labeled the “interaction gap,” is raised for two competing kinds of approaches to dispositional interaction: contribution combinationist and mutual manifestationist. After carefully highlighting and testing potential resources for closing the interaction gap, it (...) is concluded that the mutual manifestationist approach holds a significant advantage. In turn, the importance of the interaction gap itself is highlighted. While powers prime an ontology to yield an account of causation, how far that account can actually go depends on the metaphysical details of one’s view of powers and their causal interaction. This study measures social desirability bias (SD bias) by comparing the level of discipline sales managers believe they would administer when supervising unethical selling behavior with the level of discipline they perceive other sales managers would select. Results indicate the presence of SD bias; the sales manager respondents consistently claimed that they would be stricter while their peers would be more lenient. Using an analytical technique that takes social desirability bias into account, it appears that sales managers use of (...) discipline is affected by the sales performance of the salesperson being disciplined resulting in more lenient discipline for top sales performers. In addition, the more lenient treatment for top sales performers persists even when there is a pattern of a prior ethical infraction and the existence of an explicit organizational policy proscribing the act in question. Sales managers believe that, like themselves, others would be stricter when an unethical act is committed for the second time but not as strict as they personally would be. A within-subjects interaction effect indicates more SD bias under the condition of the unethical act being committed for the second time. (shrink)

Patients who are imminently dying sometimes experience symptoms refractory to traditional palliative interventions, and in rare cases, continuous sedation is offered. Samuel H. LiPuma, in a recent article in this Journal, argues that continuous sedation until death is equivalent to physician-assisted suicide/euthanasia based on a higher brain neocortical definition of death. We contest his position that continuous sedation involves killing and offer four objections to the equivalency thesis. First, sedation practices are proportional in a way that physician-assisted suicide/euthanasia is not. (...) Second, continuous sedation may not entirely abolish consciousness. Third, LiPuma’s particular version of higher brain neocortical death relies on an implausibly weak construal of irreversibility—a position that is especially problematic in the case of continuous sedation. Finally, we explain why continuous sedation until death is not functionally equivalent to neocortical death and, hence, physician-assisted suicide/euthanasia. Concluding remarks review the differences between these two end-of-life practices. (shrink)

This paper presents a cross-cultural analysis of ethics with U.S. and Hong Kong Chinese managers as subjects. These managers were given the Strategies of Upward Influence instrument and asked to evaluate the ethics of using various political strategies to attain influence within their organizations. Differences were found between Hong Kong and U.S. managers on a variety of dimensions, indicating important differences between these two groups on their perceptions of ethical behavior. Disability activists have sometimes claimed their disability has actually increased their well-being. Some even say they would reject a cure to keep these gains. Yet, these same activists often simultaneously propose improvements to the quality and accessibility of assistive technology. However, for any argument favoring assistive over curative technology to work, there must be a coherent distinction between the two. This line is already vague and will become even less clear with the emergence of novel technologies. This paper asks and (...) tries to answer the question: what is it about the paradigmatic examples of curative and assistive technologies that make them paradigmatic and how can these defining features help us clarify the hard cases? This analysis will begin with an argument that, while the common views of this distinction adequately explain the paradigmatic cases, they fail to accurately pick out the relevant features of those technologies that make them paradigmatic and to provide adequate guidance for parsing the hard cases. Instead, it will be claimed that these categories of curative or assistive technologies are defined by the role the technologies play in establishing a person’s relational narrative identity as a member of one of two social groups: disabled people or non-disabled people. Law enforcement organizations invest in ongoing education of employees on various topics concerning diversity, equity and accountability. Such education is designed to ensure the highest levels of performance and to earn the trust of the public. Traditional approaches to education, however, have proved challenging. The effectiveness of what passes as “training” is unregulated, and negative attitudes and beliefs about mandatory educational programs themselves may sabotage any possible benefits for policing. Utilizing a 2-wave, pre-/post-education panel design (N = 263), we demonstrate (...) significant, even dramatic attitude and belief change among members of a police department concerning the value and importance of implicit bias education. That the program succeeded in promoting positive attitudes and beliefs offers a possible path forward given that law enforcement desires a rational, science-based approach to improving professional conduct and police-community relations, and given increased demands for implicit bias education as a component of police reform. Self-reported attitude change is most emphatically not an indication of reduction in bias in the trenches of policing. Nevertheless, positive shifts in attitudes and beliefs about bias education is a notable step forward as it likely reduces resistance to procedures and policies for individual and institutional reform that might otherwise remain elusive. Professional associations, like the Academy of Management, exist to foster and promote scholarship, exchange among faculty, and an environment conducive to member professional ethics development. However, this last purpose of such organizations has received the least amount of attention. Moreover, previous research has demonstrated that there are differences in perceived needs for professional ethics development between tenured and untenured faculty. In the current research 260 Academy of Management members were surveyed. The research identified differences between tenured and untenured management faculty (...) with respect to expectations for the Academy of Management to provide ethics education and research with respect to the professional code of conduct. Implications of the findings are discussed from a developmental perspective. Directions for future research are provided. (shrink)

This article draws on key models of monitoring and blockholding articulated in the incomplete contracts theory of the firm. Under incomplete contracts theory, different governance systems have incentive structures that entail different tradeoffs—tradeoffs between ownership concentration and liquidity, between monitoring and management initiative, and between private rent-seeking and activity benefiting shareholders as a group. The tradeoffs delimit opportunities for productive cross-reference. More specifically, blockholder systems, such as those in Europe, subsidize monitoring by permitting blockholders to reap private benefits of control (...) through self-dealing and insider trading. Market systems, such as those in the United States and Britain, regulate such private rent-seeking toward the end of maintaining an institutional framework that supports diffuse share ownership and liquid trading markets. It follows that a legal framework conducive to blockholding may be ill-equipped to foster dispersed equity ownership and thick trading markets and that a legal framework conducive to liquid trading markets may have properties that discourage blockholding. This gives rise to questions for law reform agendas on both sides of the Atlantic. In the United States, proponents ask for deregulation of controls on institutional investors, looking to encourage blockholding and more effective monitoring. In Europe, proponents ask for stronger securities regulation, looking to encourage deeper trading markets. This article suggests that each reform program may lead to disappointing results because neither assures conforming adjustments to the pertinent actors’ incentives. Alternatively, strict reforms that materially change prevailing incentive patterns could perversely destabilize workable arrangements without assuring the appearance of more effective alternatives. The author argues that, while logical rigor requires Whiteheadians to emphasize the ontological priority of the notion of actual entity as a self-constituting subject of experience for the proper understanding of physical reality. Whitehead's understanding of the key category of society in his metaphysics, especially the way that societies and their constituent actual entities reciprocally "constrain " one another's existence and activity and the way that societies are hierarchically ordered to one another within the evolutionary process will presumably have more (...) empirical resonance with natural scientists in their own efforts to understand the emergence of life from non-life, the progressive growth of self-awareness among higher-order animal species, etc. So, in dialogue with natural scientists, why not start with what is psychologically more interesting to the listener? As death, and its allies pain and suffering, have increasingly become subject to medical treatment and social control, we think of them in new ways. However, as important as this fundamental transformation is, I have chosen to discuss something entirely different in this essay: I contend here that death has a particular sting for us of the contemporary world since we lack stories (...) and metaphors to talk about it. On the question of language about God, Moses Maimonides and Thomas Aquinas propose directly opposing viewpoints. Whereas Aquinas explicitly argues in favour of an analogical use and against an equivocal use, Maimonides on the contrary argues against an analogical use and in favour of an equivocal use of terms when applied to God. Although their respective concepts of analogical meaning appear to differ, I argue on the basis of an analysis of the criteria for analogical predication implicit in each that (...) a thomistic concept of analogical predication is reducible to a maimonidean concept. Thus, it follows that the explicit critique Maimonides lodges against an analogical use of terms when applied to God, if defensible, can be shown to be successful against Aquinas' proposal for analogical language of God. On this basis I conclude that there is a significant and defensible philosophical difference between Aquinas and Maimonides on language about God. (shrink)

Beyond Decolonial African Philosophy dives into decoloniality discourse, challenging some of its shortcomings and offering alternative perspectives on the nature of Africanity and Afrotopia (Africa's better future) from leading African philosophers. Beginning with an overview of philosophy in contemporary Africa, the first half of the book goes on to critically interrogate and rethink decoloniality's deconstructivist approach. The second half of the book considers a range of alternative new conceptualizations of Afrotopia and Africanity that transcend decolonial theory, drawing on constructivist and (...) creative approaches. The book considers key questions such as: Is Africanity immutable (essentialism), or mutable (nominalism)? Should we emphasise idealist, identitarian concerns, or pragmatic, developmentarian concerns? Should we prioritise African agency, or structures and circumstances? Should Africa embrace hybrid interculturality and creative self-manifestive identity or essentialist purity? Drawing on rich insights from African philosophers across the continent, this book challenges students and researchers to think beyond the concept of decolonization to alternative forms of African identities and African futures.
